MINISTRY OF JUSTICE AND JUDICIARY SOUTHWEST STATE OF SOMALIA

The Ministry of Justice & Judiciary is mandated to formulate and implement policies, strategies and programs for supporting , law reform, human rights, judicial affairs, prison affairs, law professional affairs, Children in conflict with the law affairs, legal-aid. The Ministry strives to ensure that people of Southwest State get access to justice specially the vulnerable groups such as women, children, minorities and Internally Displaced Persons (IDPs).

Build and maintain reliable, impartial and effective justice systems and law enforcement that are functional in every district of the state, ensuring access to justice and equality before the law to all citizens including the traditional dimensions of justice;

  1. Draft, Develop and implement SWS legal policies, judicial laws and regulations in conjunction / collaboration with FGS roles in the Constitution.
  2. Renovate, standardize, and modernize ministerial offices and judicial administration and law enforcement premises
  3. Establish a well-equipped high court building and judicial services at basic levels
  4. Safeguarding the ministerial assets and relocating missing ones.
  5. Ensure well educated and trained ministerial core cadre of staff with paid salaries according to the Civil Service Law.
  6. Following up the agreements concerning the ministry and central FGS or international levels.
  7. Registering and listing of lawyers and notaries.
  8. Supervise the proper functioning of the judiciary.
  9. Supervision and development of Custodial Corps and the prisons of the country.
  10. Supervision and development of the (appeal) courts ‘system
  11. Collaborate closely with the (future) SWS Ombudsman Commission attached to the Presidency
  12. Propose laws and the some of the members of different future standing or ad hoc commissions that might emerge such as: The Judiciary Services Commission, the Constitutional Review Commission, the Electoral Commission, the Referendum Commission; in close consultation with the Presidency;
  13. Establish frequent cooperation among the judiciary institutions in the country and the FGS or international ones.
  14. Draft and present regular seasonal reports concerning the SWS judiciary and its implementation status of justice and the rule of law.
  15. Cooperate closely with the Ministry of Reconciliation and Constitutional Affairs on SWS and FGS Constitutional matters and ongoing negotiations together with the Presidency.
  16. Notification of the executive council members/ ministers about the issues of rule of law standards.
  17. Prepare procedures of collaboration between FGS and SWS courts.
  18. Draft the policies and laws and procedures of rehabilitation of prisoners.
  19. Suggesting the abandonment and remission of sentence in concertation with the President’s prerogatives of pardon and forgiveness; inform the President about respective and eligible cases
  20. Support traditional structures and elements of the SWS judiciary and the application of Customary Law
  21. Perform additional duties and responsibilities as required by the SWS development plan and changing or emerging circumstances
